Etheon, Inc. (“Etheon,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information we collect from or about you. This Privacy Policy describes our practices regarding personal data (“Personal Data”) we collect when you access our websites, applications, and services (collectively, the “Services”).

This Privacy Policy does not apply to content we process on behalf of our enterprise customers (for example, when customers use our APIs or enterprise services). Such processing is governed by separate customer agreements.

1. Personal Data We Collect

We collect Personal Data about you in the following ways:

1.1 Personal Data You Provide

Account Information. When you create an account, we collect information such as your name, email address, contact information, account credentials, and payment details.

User Content. Any prompts, files, images, audio, or other content (“Content”) you submit to the Services.

Other Information You Provide. Information you share when responding to surveys, participating in events, or verifying your identity.

1.2 Data We Collect Automatically When You Use the Services

3. Disclosure of Personal Data

Vendors and Service Providers. With hosting providers, cloud services, analytics vendors, payment processors, and other trusted service providers who process data on our behalf.

Business Transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets.

Legal and Safety Reasons. To comply with legal obligations, enforce our Terms of Use, protect rights and safety, or respond to lawful requests from public authorities.

Affiliates. With affiliates under common control with Etheon for purposes consistent with this Policy.

Business Account Administrators. If you join an organization’s account, its administrators may access or control your account and Content.

Other Users and Third Parties You Interact With. Information you voluntarily share with other users or third-party integrations is subject to their own privacy policies.

4. Data Retention

We retain Personal Data only as long as necessary to provide Services, meet legal obligations, resolve disputes, and maintain security. Retention periods vary depending on:

The purpose for processing the data,

The amount and sensitivity of the data,

Potential risk of harm from unauthorized use,

Applicable legal requirements.

Where your settings allow (e.g., temporary chats), retention may be shorter.

5. Your Rights

Depending on your location, you may have rights to:

If you believe output generated by our AI contains inaccurate personal information about you, you may request correction or removal via privacy@etheon.ai, subject to applicable law and technical feasibility.

6. Children

Our Services are not directed to children under 13, and we do not knowingly collect Personal Data from them. If you believe a child under 13 has provided us with Personal Data, contact privacy@etheon.ai and we will take appropriate steps to delete it. Users under 18 must have parental or guardian permission to use the Services.

7. Security

We use commercially reasonable technical, administrative, and organizational measures to protect Personal Data from loss, misuse, or unauthorized access, disclosure, alteration, or destruction. However, no Internet transmission or storage system can be guaranteed 100% secure.

8. U.S. State Privacy Disclosures

Certain U.S. states provide specific privacy rights. Subject to applicable exceptions, you may have the right to:

Know and access the categories and specific pieces of Personal Data we collect and process;

Request deletion or correction of your Personal Data;

Be free from discrimination for exercising these rights.

Etheon does not “sell” Personal Data or share it for cross-context behavioral advertising.

To exercise these rights, contact privacy@etheon.ai. We may need to verify your identity before processing your request. You may also use an authorized agent with signed written permission and identity verification.

9. International Data Transfers

We process and store Personal Data in the United States and other countries where we or our service providers operate. We apply the protections described in this Policy regardless of where your data is processed and rely on legally valid data transfer mechanisms where required.

10. Changes to This Policy

We may update this Privacy Policy periodically. When we do, we will revise the “Effective” date above and, if changes are material, provide additional notice as required by law. Your continued use of the Services constitutes acceptance of any updates.
